U.S. District Judge Noël Wise of the Northern District of California ruled on Friday that Secretary of State Marco Rubio's use of the Immigration and Nationality Act to target legal noncitizens violates the First and Fifth Amendments. ^[1] Katie B. Wilson, the mayor of Seattle, was elected as part of a wave of progressive socialists who have won local, state, and federal positions across the United States in 2026. ^[2] The administration invoked provisions of the Immigration and Nationality Act allowing deportation if the secretary of state 'personally determines' speech compromises a compelling foreign policy interest, or to revoke visas at any time in his discretion. ^[3] The administration used these provisions to target noncitizens deemed radical, including Columbia University student Mahmoud Khalil, a green card holder arrested in 2025 after engaging in pro-Palestine protests on campus. ^[4] The Foundation for Individual Rights and Expression filed a lawsuit in 2025 on behalf of The Stanford Daily and Jane Doe, arguing the administration was turning free speech into a privilege contingent on the whims of a federal bureaucrat. ^[5] Mayor Wilson identifies with 'sewer socialism,' a term referencing early 20th-century socialist mayors who focused on solving concrete local problems like infrastructure, parks, and education. ^[6] More than 250 democratic socialists have been elected to local and state positions in the US recently, focusing on structural changes rather than theoretical debates. ^[7] Violent crime rates in Seattle dropped by more than 30 percent this year, but a July shooting that killed three people forced the departure of the police chief. ^[8]
