The First Collegiate Court in Criminal Matters unanimously rejected a complaint filed by the Attorney General's Office (FGR) against the decision of Judge Marcelino Niño Jiménez to suspend the trial of former Baja California governor Ernesto Ruffo Appel. ^[1] The First Collegiate Court in Criminal Matters of the State of Mexico confirmed the definitive suspension of the trial against Ernesto Ruffo Appel, the former governor of Baja California, who is accused of hydrocarbon smuggling and organized crime. ^[2] Magistrate Jorge Mario Montellano Iturralde stated that the FGR's complaint relied on generic terms regarding social interest and public order, which the legislator already considers, rather than specific legal grounds. ^[3] The court ruled that the suspension of the ordinary criminal procedure must continue until an advanced stage of the trial, specifically after the conclusion of the intermediate hearing, as established by law. ^[4] The suspension was granted by Judge Marcelino Niño Jiménez in August following a request by Ruffo Appel's legal team to suspend the intermediate stage of the trial while a protection lawsuit (amparo) was pending. ^[5] Ernesto Ruffo Appel, the former governor of Baja California, is currently detained at the Altiplano maximum security prison on charges of organized crime and oil smuggling. ^[6] By unanimity, the collegiate court resolved to declare unfounded the complaint presented by the Attorney General's Office (FGR) against the judicial decision that suspended the opening of the trial. ^[7] The court declared the grounds for grievance unfounded and upheld the suspension in the terms established by Judge Marcelino Niño Jiménez. ^[8]
