Survivors of the Bavispe massacre filed a petition in November 2025 in the US District Court for the District of Columbia requesting the transfer of a seized $3.5 million mansion in Riverside, California, to them as compensation. ^[1] The mansion, located on Pamplona Street in Riverside, was seized by the DEA from Cristian Fernando Gutiérrez Ochoa, the son-in-law of Nemesio Oseguera Cervantes, known as El Mencho, founder of the Jalisco New Generation Cartel (CJNG). ^[2] The LeBarón family and other relatives of victims of the 2019 Bavispe massacre petitioned a US federal court to use seized assets belonging to Cristian Fernando Gutiérrez Ochoa to pay part of their $4.6 billion settlement against the Juárez Cartel. ^[3] Judge Beryl A. Howell rejected the survivors' request in a 39-page opinion memorandum issued in April 2025, concluding that the arguments presented did not carry sufficient weight to prevail. ^[4] The US government opposed the petition, arguing in court documents that the Jalisco New Generation Cartel is a completely distinct organization from the Juárez Cartel, which was responsible for the Bavispe massacre. ^[5] On April 12, 2026, Judge Beryl A. Howell rejected the petition, and the families have appealed the decision. ^[6] The families argued that Gutiérrez Ochoa acted as an agent of the Juárez Cartel due to the CJNG's relationship with the cartel's armed wing, La Línea. ^[7] The US government maintained that the CJNG was not involved in the Bavispe attacks and that the seized assets should not be used for the Juárez Cartel settlement. ^[8]
