Juan Ramos, head of Puerto Rico's prosecutors, cited López to present the final investigation results, and the prosecutors concluded that the facts constituted a crime, but the Department of Justice said it lacked sufficient evidence to prosecute under the strict standard for criminal cases. ^[1] Nelsa López, widow of former Puerto Rico Governor Rafael Hernández Colón, filed a motion with the Puerto Rico State Elections Commission (CEE) to reactivate her complaint about the forgery of her signature on an endorsement for a candidate, stating that the Department of Justice could not resolve the case. ^[2] López alleged that her electoral data was used without authorization to fraudulently register an endorsement for Elmer Román González, who was then a primary candidate. ^[3] The CEE referred the complaint to the Puerto Rico Police, who worked with the Department of Justice, and on 2024-02-20 evidence of notification to the respondents was presented, but the respondents were not given a term to respond. ^[4] Nelsa López stated that officials collecting endorsements used personal phones, tablets, and prepaid phones to access electoral data, including confidential information such as Social Security numbers, which prevented linking devices to individuals. ^[5] López informed the CEE that the Department of Justice investigation concluded the facts constituted a crime, but determined there was insufficient evidence to prosecute a specific person. ^[6]
