The defense team of deposed Venezuelan President Nicolás Maduro has until Wednesday to present a motion for immunity to a federal court in New York to halt his criminal process in the United States. ^[1] Defense attorney Barry Pollack filed two motions on behalf of deposed Venezuelan President Nicolás Maduro to dismiss his criminal case in the United States. ^[2] The first motion argues that US courts lack jurisdiction to prosecute Maduro because he is a de facto head of state entitled to sovereign immunity for official acts. ^[3] Defense lawyers for Nicolás Maduro and his wife, Cilia Flores, filed a motion to dismiss narcoterrorism charges against them. ^[4] Lawyer Barry Pollack argued during Maduro's first court appearance on January 5 that Maduro enjoys immunity as head of a sovereign state and challenged the legality of his capture and transfer. ^[5] Maduro's defense questioned the jurisdiction of US courts and the legality of the January 3 military operation that ended with his capture in Caracas and subsequent transfer to the United States. ^[6] The hearing to address these issues is scheduled for November 17, before the trial which is currently planned for June 2027. ^[7] Nicolás Maduro faces charges of conspiracy to commit acts of narco-terrorism, cocaine importation, and possession of automatic weapons. ^[8] The second motion requests the dismissal of the narco-terrorism conspiracy charge, asserting it fails to allege sufficient jurisdictional elements under US law. ^[9] In his filings, Maduro's lawyer argued that a US court lacks jurisdiction because Maduro is a de facto head of state and the alleged conduct consists of acts attributable to official charges and state powers. ^[10] Lawyer Barry Pollack submitted two motions: one to dismiss all charges based on sovereign immunity, and a backup motion to dismiss only the narcotics terrorism conspiracy charge. ^[11] Attorney Barry Pollack argued that the US court lacks jurisdiction over Maduro, who is currently detained in a New York penal facility, based on his status as a de facto head of state. ^[12]
